Subject: Adoption of a Council Decision approving the accession of the European Community to the
International Convention for the Protection of New Varieties of Plants, as revised at Geneva on 19
March 1991 (UPOV)
COMMON GUIDELINES

1. On 17 December 2004, the Commission submitted to the Council a proposal for a Decision, the aim of which was the accession of the European Community to the 1961 UPOV Convention concerning international recognition of the intellectual property rights of plant variety breeders, discoverers or developers.
2. On 9 March 2005, COREPER reached a consensus 1 on the text of the Decision, without prejudice to the European Parliament's opinion, and determined that formal agreement would be reached as an "A" item on the Council agenda, once this opinion had been given.

3. As Parliament approved the proposal for a Decision at its part-session in May 2005, COREPER could therefore invite the Council to:
